Article 1

Definitions

In these terms and conditions, the following words have the meanings set out below:

  • Consumer: a natural person who places an Order with Nieuweboer Wines for personal, non-commercial purposes and who is not acting in the course of a trade, business, craft, or profession.
  • Nieuweboer Wines: the company operating the Website and offering Products for sale, as further identified in Article 3.
  • Order: a request submitted by the Consumer to purchase one or more Products from Nieuweboer Wines via the Website.
  • Agreement: the purchase agreement concluded between Nieuweboer Wines and the Consumer following acceptance of an Order, as described in Article 7.
  • Products: wines and other alcoholic beverages offered for sale on the Website.
  • In writing / written: any message sent by post, email, or through the Website's contact forms or account portal, provided we can establish who sent it and that the content has not been changed in transit.
  • Website: the webshop operated by Nieuweboer Wines, accessible at nieuweboerwines.com.

About These Terms

These terms apply to every offer made by Nieuweboer Wines and every agreement concluded with a consumer who places an order through our website.

By placing an order, you confirm that you have read and accepted these terms. A copy is always available on this page and is included with your order confirmation email.

We may update these terms from time to time. Any revised version will be published on the website and will apply only to orders placed after that publication date.

These terms apply only to consumers buying for personal, non-commercial use. If you are buying on behalf of a business, please contact us directly so we can confirm the right terms.

These terms govern transactions made through the website, to the exclusion of any other terms a consumer may try to apply, unless we have agreed otherwise in writing.

If any part of these terms is found to be unlawful or unenforceable, that part will be replaced by the nearest valid equivalent and the rest will remain in force.

Nieuweboer Wines holds the necessary licence(s) to sell and supply alcoholic beverages in the Netherlands in accordance with the Drank- en Horecawet (DHW).

Article 4

Age Restriction

The sale of alcoholic beverages to persons under the age of 18 is prohibited by Dutch law (Drank- en Horecawet). By placing an order, you confirm that you are 18 years of age or older.

We will ask you to confirm your age during checkout. If we have reasonable grounds to doubt that you meet the minimum age requirement, we reserve the right to refuse or cancel the order and refund any payment made.

Delivery personnel are instructed not to hand over orders containing alcohol to anyone who appears to be under the age of 18, or to anyone who cannot produce valid proof of age when asked to do so. In such cases the order will be returned and a refund will be processed.

By providing false information about your age, you assume full responsibility for any consequences under applicable Dutch law. Nieuweboer Wines cannot be held liable in such circumstances.

Article 5

Products and Availability

All product descriptions, tasting notes, vintage information, and images on our website are provided in good faith and to the best of our knowledge. Small differences in label design or packaging may occur without notice.

Our range is subject to change. A wine shown on the website is an offer to sell while stocks last. Nieuweboer Wines cannot guarantee availability at the exact moment of your order.

If a wine you have ordered turns out to be unavailable after your order has been placed, we will inform you as soon as possible. You will have the option to select an alternative product, accept a credit note, or receive a full refund for the unavailable item.

Vintage variations may occur when a listed vintage sells out and a new vintage becomes available. Where this happens we will inform you before dispatch and give you the opportunity to cancel if you prefer.

Article 6

Pricing and VAT

All prices shown on the website are in euros (€) and include Dutch VAT (BTW) at the applicable rate. Wine is subject to the standard VAT rate of 21%. The applicable VAT amount will be shown on your invoice.

Shipping costs are not included in the product price and will be displayed clearly before you confirm your order. The final total, including all costs, is shown on the order summary page before payment is required.

Nieuweboer Wines reserves the right to adjust prices at any time. Price changes will not affect orders that have already been confirmed.

On rare occasions a price may appear on our website because of a technical fault and clearly not reflect the wine's normal selling price. In that case Nieuweboer Wines may withdraw the offer before the agreement is formed. If we discover the error only after sending your order confirmation, we will contact you before taking any further action. You can then choose to pay the correct amount or receive a full refund.

Article 7

Order Process and Formation of Agreement

Listing a wine on our website is an invitation to place an order. It is not a binding commitment on our part to sell. The purchase agreement between you and Nieuweboer Wines comes into existence when we send your order confirmation by email. Until that email is sent, no contract exists.

The order process consists of the following steps:

  • Select products and add them to your basket.
  • Proceed to checkout and enter your delivery and billing details.
  • Confirm your age and accept these terms and conditions.
  • Review your order summary, including total price and shipping costs.
  • Complete payment.
  • Receive an automated order confirmation by email.

If you notice an error in your order after confirmation, please contact us immediately at contact@nieuweboerwines.com. We will do our best to accommodate changes, but we cannot guarantee them once an order has moved into fulfilment.

Nieuweboer Wines reserves the right to refuse an order for legitimate reasons, including but not limited to: inability to verify age, payment issues, or suspicion of commercial resale. In such cases any payment received will be refunded promptly.

Article 8

Payment

Payment is due in full at the time of placing your order. We do not offer credit or deferred payment terms for consumer orders.

We accept the following payment methods:

iDEAL, Visa, Mastercard, American Express, and Revolut Pay.

All payment transactions are processed through a secure, encrypted payment environment. Nieuweboer Wines does not store your full card details.

If a payment is declined or reversed, the order will not be processed or dispatched. We will notify you by email and invite you to complete payment using an alternative method.

Article 9

Delivery

Nieuweboer Wines delivers exclusively within the Netherlands. We do not ship internationally.

Orders are typically dispatched within 1 to 2 business days of payment confirmation. Delivery usually takes a further 1 to 2 business days from the moment of dispatch. Delivery times are estimates and not guaranteed.

Quoted delivery times are working estimates, not guaranteed deadlines. If your order has not arrived by the expected date, please contact us in writing first and allow us a fair additional window to complete the delivery. Only once that extended window closes without delivery may you cancel the order and request a full refund.

We use specialist wine packaging designed to protect against shock and temperature variation during transit. Deliveries are handled by PostNL. A tracking link will be included in your dispatch notification email.

Delivery requires a signature or confirmation of receipt. If you are not present at the time of delivery, the carrier will follow their standard re-delivery procedure. Please note that wine may not be left unattended at a location where it could be accessed by persons under 18.

If a package is returned to us as undeliverable after repeated delivery attempts, we will contact you to arrange re-delivery. Additional shipping charges may apply. Unclaimed parcels that are returned to us and not re-ordered within 14 days will be refunded, minus the original shipping cost.

Shipping costs, minimum order requirements (if any), and any applicable free-delivery thresholds are shown at checkout before you confirm your order.

Article 10

Transfer of Risk

Responsibility for your bottles passes to you at the moment they are handed over at your delivery address. Until that handover takes place, the risk of loss or damage during transit remains with Nieuweboer Wines.

If a delivery is damaged in transit, please note any visible damage on the carrier's delivery document if possible, and notify us within 48 hours of receipt by email with a description and photographs of the damage. We will assess the situation and arrange a replacement or refund as appropriate.

Until delivery is completed, risk remains with Nieuweboer Wines. In the event of loss or damage during shipping, we will work with our carrier to resolve the matter promptly.

Article 11

Right of Withdrawal

As a consumer buying from a Dutch online retailer, you have the right to withdraw from an Agreement without giving any reason, within 14 calendar days of the day you, or a person you designate, receive the goods. This right follows from European consumer law as implemented in Dutch law.

How to exercise your right of withdrawal

To cancel, send us a clear written notice before the 14-day window closes. An email to contact@nieuweboerwines.com saying you want to return your order is all that is needed. The Dutch Consumer Authority (ACM) publishes a standard cancellation form at acm.nl that you may use if you prefer, but it is not compulsory.

Inspection and condition of returned goods

You may take a bottle out of the shipping box or case and inspect it closely, including the label, fill level, and condition of the closure, without losing your cancellation right, as long as the bottle's own seal remains unbroken. Once a bottle is opened and wine is consumed from it, that bottle can no longer be returned. An open bottle deteriorates immediately and cannot be restocked.

You must return the goods within 14 days of notifying us of your withdrawal. Bottles must be sealed and in their original, intact packaging.

Return costs and refund timing

Return shipping costs are borne by you. Nieuweboer Wines does not arrange or pay for return transport unless we agree otherwise in writing.

We will issue your refund within 14 days of receiving the returned goods, or within 14 days of receiving proof that you have dispatched them, whichever is earlier. Refunds will be made using the same payment method as the original purchase. We will not charge any fee for processing a valid withdrawal.

Shipping costs for the original order are refunded only if you are withdrawing from the entire order. If you return only part of an order, the original shipping costs are not refunded.

Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

  • Bottles that have been opened or whose seal has been broken, as wine is a perishable product that deteriorates once unsealed.
  • Wines sold at a price fixed at order time where delivery is scheduled more than 30 days later and the wine's market value may shift in the interim through forces outside our control, for example certain fine wine allocations or pre-release offers. This exception is provided for in Article 6:230p(i) of the Dutch Civil Code.
  • Products that have been clearly personalised or customised for you.
  • Products that have been damaged through your own actions after delivery.

If you return goods that do not meet the above conditions, we reserve the right to refuse the return or to apply a proportionate reduction to the refund to account for any diminished value.

Article 12

Returns and Refunds

Before sending anything back, email us at contact@nieuweboerwines.com to register the return and receive a confirmed return address. Do not send bottles back without this prior confirmation, as unannounced returns may cause delays.

Pack returns carefully to prevent breakage in transit. The original shipping materials work best if you still have them. We cannot accept responsibility for bottles that arrive broken because they were not wrapped properly. For all refund terms, timing, and conditions, see Article 11.

Article 13

Complaints and Defective Products

Inspection on delivery

Please inspect your order on delivery. If there is visible damage to the outer packaging, note this on the carrier's delivery document, whether paper or digital, before signing or accepting. That helps protect your position when you report the damage to us.

Reporting a problem

If something is wrong with your delivery, please email contact@nieuweboerwines.com within two working days of receiving your order. Include your order number, a description of the problem, and photographs where you have them. Once this window has passed, we treat the delivery as having arrived in the condition described and cannot process claims for faults that were visible or reasonably discoverable at the time.

Raising a complaint with us does not put a hold on any payment you owe for goods already in your possession.

Corked or otherwise faulty wine

Wine is an agricultural product and occasional faults do occur. If you open a bottle and find it undrinkable, whether because of cork taint, oxidation, or another fault, please do the following:

  • Re-seal the bottle immediately, push the cork back in or use a stopper, and store it somewhere cool. Do not pour the wine away.
  • Email us at contact@nieuweboerwines.com within two days of opening the bottle, with your order number and a brief description of what you found.
  • Wait for our acknowledgement before sending anything back. We will confirm a return address and procedure. Do not post bottles to us without prior agreement.
  • Once we receive the bottle we will examine it. If the fault is confirmed, we will arrange a free replacement. If the same wine is no longer available or cannot be sourced at its original price, we will instead refund the amount you paid for that bottle.

Aged wines

Very mature wines carry a level of unpredictability that no retailer can fully control. Nieuweboer Wines does not offer quality assurances beyond those required by law for red wines that are more than twelve years old from their harvest year at the point of sale, or white wines that are more than four years old, given the natural variation that extended cellaring introduces. Your statutory rights under Dutch consumer law are not affected by this.

Dispute resolution

If you are not satisfied with our response to your complaint, you have the option to submit your complaint to the relevant dispute resolution body. As a consumer in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/odr. Our email address for ODR purposes is contact@nieuweboerwines.com.

Article 14

Liability

Where Nieuweboer Wines has failed to meet an obligation under these terms through our own fault, we are responsible for the direct loss that results. Our financial responsibility for any single claim is capped at the amount you actually paid for the specific products to which the claim relates.

Nieuweboer Wines is not liable for:

  • Indirect or consequential damages, including but not limited to loss of income, loss of profit, or reputational damage.
  • Damages resulting from incorrect or incomplete information provided by the consumer (for example, an incorrect delivery address or a false declaration of age).
  • Damages arising from the consumer's misuse of the product, including consumption of alcohol in a manner that violates applicable laws or guidelines.
  • Disruptions to the website or checkout process caused by factors outside our reasonable control.

These limitations do not override protections that Dutch consumer law makes mandatory. Where the law does not permit liability to be restricted, for instance in cases of personal harm arising from our negligence, those rights remain fully intact.

Article 15

Force Majeure

Nieuweboer Wines will not be held liable for a failure to perform, or a delay in performing, any of our obligations under these terms where such failure or delay is caused by circumstances beyond our reasonable control.

Such circumstances include, but are not limited to: natural disasters, extreme weather events, fire, flooding, strikes or industrial action (whether or not involving our own staff), disruptions to transport networks, government restrictions, pandemic-related measures, or a failure by a third-party supplier or carrier that could not reasonably have been foreseen or avoided.

When a force majeure situation arises, we will let you know as quickly as we are able to. Depending on the nature and expected duration of the disruption, we will either hold your order until the situation clears, or we will give you the option of cancelling for a complete refund. If the disruption has not been resolved within 45 days, you are entitled to cancel and we will return every euro you have paid.

Article 16

Limitation Period

Compensation claims against Nieuweboer Wines must be submitted within one year of the delivery date of the order to which the claim relates. Claims reaching us after this deadline will not be accepted.

This one-year limit does not apply where Dutch consumer law sets a longer period that cannot be shortened by contract. In those situations, the statutory period takes precedence.

Article 17

Privacy and Personal Data

Nieuweboer Wines processes personal data in accordance with the General Data Protection Regulation (GDPR) as implemented in the Netherlands by the Uitvoeringswet AVG. We process your personal data only to the extent necessary to fulfil your order, communicate with you, and comply with our legal obligations.

For full details on how we collect, use, store, and protect your personal data, as well as information on your rights as a data subject, please refer to our Privacy Policy.

By placing an order, you acknowledge that your personal data will be shared with third parties where necessary to fulfil your order, such as payment processors and delivery carriers. These third parties are bound by appropriate data processing agreements and are not permitted to use your data for any other purpose.

Article 18

Intellectual Property

All content on the Nieuweboer Wines website, including but not limited to text, product descriptions, tasting notes, photography, graphics, the logo, and the overall design, is the intellectual property of Nieuweboer Wines or its licensors and is protected by applicable Dutch and European intellectual property law.

Nothing on this website may be reproduced, distributed, modified, or used for commercial purposes without the prior written consent of Nieuweboer Wines. Personal, non-commercial use (for example, saving a screenshot for your own reference) is permitted provided that the content is not altered and its origin is not misrepresented.

Article 19

Governing Law and Disputes

Dutch law governs these terms and every agreement formed under them. If a dispute cannot be settled between us directly, the matter goes before the appropriate Dutch court. Nieuweboer Wines' home district is the default jurisdiction, though consumer protection law gives you the right to bring proceedings before the court for your own address instead.

As a consumer you may also choose to use an alternative dispute resolution route before going to court (see Article 13).

These terms are drawn up in the Dutch language. Should a translated version exist and any discrepancy arise between it and the Dutch text, the Dutch version takes precedence. The version currently published on the Website is always the version in force.
